Warranty and Disclaimer of Warranties

DELTA GROW SEED COMPANY warrant that the products they sell will be labeled as required by law and that they will conform to the label description. DELTA GROW SEED COMPANY and SELLER MAKE NO OTHER EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR OTHERWISE. There are no guarantees of crop yield or freedom from seed-borne disease. Any recommendations for use of these products or materials or apparatus in connection therewith are based upon DELTA GROW SEED COMPANY or Seller's best judgment, but there is no warranty of results to be obtained in connection therewith. 

Limitations of Liability

The exclusive remedy for loss or damage due to breach of the foregoing warranty or contract, or for negligence or other cause shall be limited to return of purchase price of DELTA GROW SEED COMPANY products and shall not include any consequential damages. Claims for defects in DELTA GROW SEED COMPANY products must be presented to Monsanto Company as soon as practicable to enable Monsanto Company to investigate the claim and in any event within thirty (30) days after discovery.

These seeds are protected under one or more of the following United States Patent nos. 4,940,835; 5,188,642; 5,352,605; 5,530,196; 5,633,435; 5,717,084; 5,728,925; and 5,804,425. The purchase of these seeds conveys no license under said patents to use these seeds or perform any of the methods covered by these patents. A license must first be obtained before these seeds can be used in any way. See your Seed Dealer to sign a Monsanto Technology/Stewardship Agreement or to obtain a Limited Use Invoice License. Progeny of these seeds cannot be used for replanting or transferred to others for replanting.

It is a violation of national and international law to move material containing biotech traits across boundaries into nations where import is not permitted. Growers should talk to their grain handler or product purchaser to confirm their buying position for this product.
